# Res judicata? Decided on merits?

> When the same matter was directly and substantially in issue between the same parties, before a competent court, and was heard and finally decided. A compromise statement without a decision on merits does not bar a new suit (PLD 2025 Pesh. 59), but a dismissal for want of evidence after issues does (2026 CLC 859).

## The bar.

Section 11, CPC.

> "No Court shall try any suit or issue in which the matter directly and substantially in issue has been directly and substantially in issue in a former suit between the same parties, or between parties under whom they or any of them claim, litigating under the same title, in a Court competent to try such subsequent suit … and has been heard and finally decided by such Court." (Code of Civil Procedure, 1908 · Section 11)

## Four elements.

All four, every time.

- **Same matter** Directly and substantially in issue in both suits.
- **Same parties** Or those claiming under them, under the same title.
- **Competent court** Competent to try the later suit (Expl. II).
- **Finally decided** Heard and finally decided.

## Quick quiz. A compromise.

Guess first, then swipe for the answer.

- **A. Yes, always**
- **B. No, nothing was decided on merits**
- **C. Only if it was registered**

## Answer: B. No merits, no bar.

Peshawar High Court.

- **PLD 2025 Pesh. 59** A decision on statements, without conclusive determination on merits, is a compromise and does not attract res judicata.
- **2025 CLC 1537** A suit dismissed as withdrawn left no decree, so res judicata could not be pressed.

## Myth or fact?

The "no evidence" dismissal.

- **Myth: My suit was dismissed for want of evidence, not on merits. I can sue again.**
- **Fact: Once issues were framed and evidence opportunities given, dismissal under O.XVII R.3 is on merits. The second suit was barred (2026 CLC 859, Lahore High Court).**

## Explanation IV.

Constructive res judicata.

- **Might and ought** Grounds that might and ought to have been raised are deemed raised.
- **2026 CLC 859** New defendants or a rephrased plaint do not create a fresh cause of action.
- **2021 CLC 187** With O.II R.2, a plaintiff cannot split one cause of action (Balochistan).

## Three more turns.

Know the edges.

- **2025 SCMR 430** Partition is an independent right. An earlier declaratory suit not decided on merits does not bar it.
- **2022 MLD 1961** Chose s.12(2) and lost? A later O.IX R.13 application was barred (Islamabad).
- **PLD 2022 Sindh 378** A conclusive foreign judgment can operate as res judicata, read with s.13.

## Raise it right.

Three things on the record.

- **The record** Certified copies of the earlier plaint, issues, judgment and decree.
- **The match** Same matter, same parties or title, competent court, final decision.
- **The remedy** Rejection under O.VII R.11(d) where the bar shows from the plaint and admitted record.

## Draft it with FAI.

Ask FAI in your own words. It answers with the exact section and the leading judgments.

- **Does dismissal under Order XVII Rule 3 operate as res judicata? Recent cases.**
- **Draft an application under Order VII Rule 11 on res judicata.**

## What this does not mean

- A decision on compromise statements, without a conclusive determination on merits, does not attract res judicata (PLD 2025 Pesh. 59).
- A suit dismissed as withdrawn left no decree, so res judicata could not be pressed (2025 CLC 1537).
- An earlier declaratory suit not decided on merits does not bar a partition suit, since partition is an independent right (2025 SCMR 430).

## Questions people ask

### What is res judicata under section 11 CPC in Pakistan?

It bars a court from trying a matter already decided. Four elements must be present: the same matter directly and substantially in issue, the same parties or those claiming under them under the same title, a court competent to try the later suit, and a hearing and final decision.

### Does a compromise decree bar a fresh suit?

Not where nothing was decided on merits. The Peshawar High Court held that a decision on statements without conclusive determination on merits is a compromise and does not attract res judicata (PLD 2025 Pesh. 59).

### Can I file a new suit after my suit was dismissed for lack of evidence?

Usually not. Once issues were framed and evidence opportunities given, a dismissal under O.XVII R.3 is on merits, and the second suit was barred (2026 CLC 859, Lahore High Court).

### What is constructive res judicata?

Under Explanation IV to section 11, grounds that might and ought to have been raised in the earlier suit are deemed raised. Adding new defendants or rephrasing the plaint does not create a fresh cause of action (2026 CLC 859).

### How do I raise res judicata in a civil suit?

Put certified copies of the earlier plaint, issues, judgment and decree on the record and show all four elements match. Where the bar shows from the plaint and admitted record, seek rejection under O.VII R.11(d).
