## Myth or fact?

What people say after a divorce.

- **Myth: The dowry stays in the husband's house.**
- **Fact: Dowry articles are always the property of the wife, whoever purchased them (2018 CLCN 86, Lahore High Court).**

## Which court? The Family Court.

Dowry is in its own list.

> "1. Dissolution of marriage, including Khula. 2. Dower. 3. Maintenance. … 8. Dowry. 9. The personal property and belongings of a wife and a child living with his mother. 10. Any other matter arising out of the Nikahnama." (Family Courts Act, 1964 (Punjab) · Schedule, Part I)

## Quick quiz. Who paid?

Guess first, then swipe for the answer.

- **A. The groom's family**
- **B. The wife**
- **C. Half and half**

## Answer: B. The wife.

The court looked at the list, the evidence and wear and tear.

- **Who paid** Does not matter. Dowry articles were always the property of the wife (2018 CLCN 86).
- **Value** The Family Court fixed an alternate price for articles not returned (same case).

## Keep these papers.

In court, she must prove the claim.

- **The list** A list of dowry articles, filed with the plaint.
- **Receipts** Gold receipts not in her or her family's name failed to prove the claim (2020 CLCN 8, Sindh High Court).
- **Witnesses** People who saw the articles delivered, often days before rukhsati (2017 CLC 1328, Lahore High Court).

## One suit, every claim.

Section 7(2), Family Courts Act (Punjab).

- **File** In the Family Court (s.5, Schedule).
- **Join claims** A plaint for dissolution may include dowry, maintenance, dower and her personal property (s.7(2) proviso).
- **Decree** Return of the articles, or their price.

## Myth or fact?

When nobody signed anything.

- **Myth: No signed list means no dowry claim.**
- **Fact: It is not possible for a wife to keep a record and get the husband's signatures; the court still assessed the articles (2020 CLC 380, Balochistan High Court).**

## Two more things to know.

Gold, and appeals.

- **Gold in the nikahnama** Where dower is 7 tola gold, she may choose the gold itself over a nominal alternate value (2025 CLC 1048, Lahore High Court).
- **Small decrees** In Punjab, no appeal lies from a decree for dower or dowry up to Rs 100,000 (s.14(2)(b)).

## Get her things back.

Ask FAI in your own words. It answers with the exact law and the judgments behind it.

- **My sister was divorced and her in-laws kept her dowry. How do we get it back?**
- **Draft a suit for recovery of dowry articles before the Family Court.**

## What this does not mean

- Dowry belonging to the wife does not mean every claim succeeds without proof. In court she must prove the claim, for example with a list, receipts and witnesses.
- The Family Courts Act points in this carousel are from the Punjab text.
- In Punjab, no appeal lies from a decree for dowry up to Rs 100,000 (s.14(2)(b)).
