# Entered your home? That can be a crime.

> Entering property in another's possession to commit an offence, or to intimidate, insult or annoy, is criminal trespass under section 441 PPC. In a home it is house-trespass (s.442), up to 1 year (s.448), and up to 7 years and fine if the trespasser came prepared to hurt (s.452). But the intent matters: courts have refused to let a civil dispute be run as a trespass case.

## Myth or fact?

What people often think.

- **Myth: Every entry onto my land is criminal trespass.**
- **Fact: Entry becomes criminal trespass when it is to commit an offence, or to intimidate, insult or annoy the person in possession (PPC s.441).**

## The law.

Section 441, PPC.

> "Whoever enters into or upon property in the possession of another with intent to commit an offence or to intimidate, insult or annoy any person in possession of such property, or, having lawfully entered into or upon such property, unlawfully remains there with intent thereby to intimidate, insult or annoy any such person, or with intent to commit an offence, is said to commit "criminal trespass"." (Pakistan Penal Code, 1860 · Section 441)

## Two kinds.

Sections 441 and 442, PPC.

- **Criminal trespass, s.441** Any property in another person's possession.
- **House-trespass, s.442** A building used as a home, a place of worship, or to keep property.

## Even a hand counts.

How little it takes.

- **Entering** Putting any part of the body inside is enough (s.442, Explanation).
- **Staying on** Entering lawfully, then staying on to intimidate, insult or annoy, is trespass too (s.441).

## How serious?

Sections 447 to 456, PPC.

- **Criminal trespass, s.447** Up to 3 months, or fine, or both.
- **House-trespass, s.448** Up to 1 year, or fine, or both.
- **Ready to hurt, s.452** After preparing for hurt or assault: up to 7 years, and fine.
- **By night, s.456** Lurking or house-breaking by night: up to 3 years, and fine.

## Quick quiz. The plot.

Guess first, then swipe for the answer.

- **A. Yes**
- **B. No, a plot is not a house**
- **C. Only at night**

## Answer: B. A plot is not a house.

2025 PCrLJ 492, Balochistan High Court.

- **The plot** A residential plot is not a house, so s.448 did not arise.
- **The intent** Under s.441 the dominant intention must be to commit an offence, or to intimidate, insult or annoy.
- **The result** With neither alleged, the proceedings were declared without lawful authority.

## Not a shortcut for civil cases.

What courts have said.

- **2016 MLD 941** Relief that belongs in civil proceedings was sought through a criminal case. The acquittal stood (Sindh High Court).
- **2018 YLRN 158** If the main intention was something else, s.441 does not apply (Peshawar High Court).

## What to do.

Three steps, in this order.

- **Record** Photos, video, witnesses and the time of entry.
- **Police** For house-trespass, police may arrest without warrant (Schedule II, s.448).
- **Land taken?** A complaint under the Illegal Dispossession Act, 2005.

## Someone walked in?

Ask FAI in your own words. It answers with the exact section and the judgments behind it.

- **A relative entered my house and threatened my mother. Which sections apply?**
- **Is entering an open plot criminal trespass under section 447 PPC?**
