## A bounced cheque can be a crime.

If a cheque given to repay a loan or meet an obligation is dishonestly issued and bounces, the Penal Code applies.

> "shall be punished with imprisonment which may extend to three years or with fine, or with both" (Pakistan Penal Code · Section 489-F)

## What the law table says.

Schedule II of the Code of Criminal Procedure lists how every offence is handled.

- **Arrest without warrant** Police may arrest without a warrant.
- **Not bailable** Bail is not a right; the court decides.
- **Compoundable** The parties can settle the case.
- **Tried by** A Magistrate of the first class.

## The one defence the section names.

The person who wrote the cheque must prove it, the burden is on them.

- **They had arranged with their bank** To make sure the cheque would be honoured.
- **And the bank was at fault** In not honouring it.

## Owed money? There is a civil route too.

A cheque is a bill of exchange in law (Negotiable Instruments Act, s.6), so a recovery suit can be filed as a summary suit.

- **File: Summary suit** Order XXXVII, Code of Civil Procedure.
- **10 days: Defendant must ask leave to defend** From service of summons (Limitation Act, Art. 159).
- **If not: Plaint taken as admitted** The plaintiff is entitled to a decree.

## What this does not mean

- Not every bounced cheque is a crime under s.489-F PPC. It must be issued dishonestly to repay a loan or meet an obligation.
- The offence is not bailable, which means bail is not a right and the court decides.
- The section names one defence, and the person who wrote the cheque must prove it: he had arranged with his bank, and the bank was at fault.
