## Myth or fact?

The first fear.

- **Myth: An FIR means I am already guilty.**
- **Fact: An FIR starts an investigation. Guilt is decided at trial, and the court can acquit at any stage (CrPC ss.249-A, 265-K).**

## Step one. Pre-arrest bail.

Before you are arrested.

- **The power** The High Court or Court of Session may direct that any person be admitted to bail (CrPC s.498).
- **Show mala fide** Pre-arrest bail was confirmed where the complainant hid a family dowry dispute behind the FIR (2023 SCMR 967).
- **Civil dispute** False implication to gain in civil litigation could not be ruled out: bail granted (2022 SCMR 1424).

## Quick quiz. Quash it now?

Guess first, then swipe for the answer.

- **A. Yes, always**
- **B. Usually no, there are other remedies**
- **C. Only if the police agree**

## Answer: B. Other remedies first.

The Supreme Court on early quashing.

- **2006 SCMR 1192** Disputed facts need evidence; the accused had alternative remedies before the trial court under ss.249-A and 265-K.
- **Art. 199** The High Court acts only if no other adequate remedy is provided by law.

## The trial court can end it early.

Section 265-K, CrPC.

> "Nothing in this Chapter shall be deemed to prevent a Court from acquitting an accused at any stage of the case, if, after hearing the prosecutor and the accused and for reasons to be recorded, it considers that there is no probability of the accused being convicted of any offence." (Code of Criminal Procedure, 1898 · Section 265-K)

## Police can cancel it.

When the case is found false.

- **Join investigation** Give the police your evidence early.
- **Cancellation** Police may seek it where information is maliciously false, false by mistake, or fit for a civil suit (2021 PCrLJ 1038).
- **Speaking order** The Magistrate must apply his own mind, not just stamp the police report (same case).

## Can the complainant pay?

Section 182, Pakistan Penal Code.

- **The offence** Giving a public servant false information to injure someone (PPC s.182).
- **Who complains** Only the public servant concerned, in writing (CrPC s.195(1)(a)).
- **In practice** The police decide whether to proceed (2016 MLD 346, Sindh High Court).

## Myth or fact?

The hide and wait plan.

- **Myth: If I disappear for a while, the FIR will go away.**
- **Fact: Courts weigh your conduct. The accused in 2023 SCMR 967 joined the investigation and kept his bail.**

## Named in a false FIR?

Ask FAI in your own words. It answers with the exact section and the judgments behind it.

- **My cousin filed a false FIR against me over a land dispute. What should I do first?**
- **Grounds for pre-arrest bail where the FIR is mala fide.**

## What this does not mean

- An FIR starts an investigation. It is not a conviction, and guilt is decided at trial.
- Quashing an FIR in the High Court is not the usual first step. The Supreme Court said the accused had remedies before the trial court under ss.249-A and 265-K (2006 SCMR 1192).
- You cannot start a case under PPC s.182 yourself. Only the public servant concerned can complain, in writing (CrPC s.195(1)(a)).
