## The section.

Section 489-F, PPC.

> "Whoever dishonestly issues a cheque towards repayment of a loan or fulfilment of an obligation which is dishonoured on presentation, shall be punished with imprisonment which may extend to three years or with fine, or with both, unless he can establish … that he had made arrangements with his bank to ensure that the cheque would be honoured and that the bank was at fault in not honouring the cheque." (Pakistan Penal Code, 1860 · Section 489-F)

## Three elements.

2024 SCMR 1567, Supreme Court.

- **Dishonest intent** The cheque was issued dishonestly.
- **Loan or obligation** Towards repayment of a loan or fulfilment of an obligation.
- **Dishonoured** It bounced on presentation.

## Security cheque.

Element 2 fails.

- **Guarantee** Cheque given as guarantee under a plot agreement: pre-arrest bail (2024 SCMR 1567).
- **Acquittal upheld** Cheque issued as guarantee, not repayment: s.489-F not attracted (2020 PCrLJ 1126, Islamabad).
- **Old cheque** Undated security cheque presented years later: acquittal upheld (2021 YLR 114, Sindh).

## Myth or fact?

The bare plea.

- **Myth: Just say "security cheque" and bail follows.**
- **Fact: An unconditional bounced cheque raises a prima facie presumption of an obligation. The plea needs proof (2019 PCrLJ 1759, Sindh).**

## Where is the debt?

No proof of the underlying payment.

- **2024 SCMR 1596** No details of the business deal, no receipt for the cash: further inquiry, bail.
- **2021 SCMR 2092** Cash paid in instalments, no agreement, no receipt: bail.

## Not a recovery suit.

Civil disputes dressed as crimes.

- **2023 SCMR 2122** s.489-F is not meant for recovery. Civil remedies exist, including Order XXXVII CPC.
- **2023 SCMR 1977** Tenant and landlord: rent claims fall to the Rent Controller.

## Quick quiz. Bail?

Guess first, then swipe for the answer.

- **A. The offence is bailable**
- **B. Outside the prohibitory clause**
- **C. The cheque amount is small**

## Answer: B. Three years max.

Section 497(2), CrPC.

- **Not prohibitory** Maximum three years, outside the prohibitory clause of s.497 (2022 SCMR 592).
- **Further inquiry** Whether the cheque was for an obligation is for the trial (2023 SCMR 1977).
- **Also seen** Signature mismatch on a joint account, woman with children: bail (2021 SCMR 1227).

## Draft it with FAI.

Ask FAI in your own words. It answers with the exact section and the leading judgments.

- **Supreme Court cases on security cheques under section 489-F PPC.**
- **Draft a post-arrest bail petition in a 489-F case.**

## What this does not mean

- Section 489-F is not meant for recovery of money. Civil remedies exist, including Order XXXVII CPC (2023 SCMR 2122).
- Simply calling it a security cheque is not enough. An unconditional bounced cheque raises a prima facie presumption of an obligation, and the plea needs proof (2019 PCrLJ 1759).
- At the bail stage the court does not finally decide whether the cheque was for an obligation. That is for the trial (2023 SCMR 1977).

## Questions people ask

### What are the ingredients of 489-F PPC?

The Supreme Court lists three: the cheque was issued dishonestly, it was towards repayment of a loan or fulfilment of an obligation, and it was dishonoured on presentation (2024 SCMR 1567).

### Does 489-F apply to a security cheque?

Where a cheque was given as a guarantee and not for repayment, courts have held the second element fails. Pre-arrest bail was granted in 2024 SCMR 1567 and an acquittal was upheld in 2020 PCrLJ 1126.

### Is bail granted in 489-F cases?

The maximum is three years, which is outside the prohibitory clause of s.497 CrPC (2022 SCMR 592). Bail was granted where there was no proof of the underlying payment (2024 SCMR 1596; 2021 SCMR 2092).

### What is the punishment under 489-F PPC?

Imprisonment up to three years, or fine, or both. The accused escapes if he proves he had arranged with his bank for the cheque to be honoured and the bank was at fault.

### Can a landlord file a 489-F case for unpaid rent?

In a landlord and tenant matter, the Supreme Court said rent claims fall to the Rent Controller (2023 SCMR 1977).
